These general terms and conditions (the "General Terms and Conditions") regulate the use of the internet portal website www.colombia.travel (the "Website") that PROCOLOMBIA, previously PROEXPORT ("PROCOLOMBIA") provides internet users.

Use of the Website gives the status of user of the Website (hereinafter, the "User") and is an express, full and unreserved acceptance by the User of all the General Terms and Conditions in the version published by PROCOLOMBIA at the time the User accesses the Website. As a result, the User must carefully read the General Terms and Conditions whenever they intend to use the Website.

Use of certain services offered to Users through the Website is subject to specific terms and conditions that may replace, complete and/or amend the General Terms and Conditions (the "Specific Terms and Conditions"), as the case may be. Similarly, the use of the Service is also subject to all the notifications, rules of use and instructions issued to the User by PROCOLOMBIA, which complete the provisions of these General Terms and Conditions so long as they do not contradict them.

Modification, reproduction, publication or transfer of any Content to other persons, or use for any purpose except as permitted by the law in force, it forbidden. Likewise, it is forbidden to disassemble, decompile, reverse engineer or attempt by any means to break the protection of the content. All contents, elements and information on this Site including all text, format, images, music, brands, logos, images, trade names, sounds, graphics, videos, animation, and other materials on this Website are owned by PROCOLOMBIA, its subsidiaries and affiliates and controllers, and those of third-party contractors, licensors or assignors, as applicable. Some of the Content is protected by copyright and trademark laws. Any unauthorized use of the Services and Content of the Website that violates the property and intellectual property rights of PROCOLOMBIA or third parties may lead to the corresponding legal actions being brought by the rights holders. Access to or use of this Website will not in any way imply the granting or refusal of any license, concession or right of use over any of the trademarks, names, logos, designs or Content protected by the intellectual property right of PROCOLOMBIA or any third party, as applicable. The establishment of the Hyperlink does not imply in any case the existence of relations between PROCOLOMBIA and the owner of the website on which it is established, nor the acceptance and approval by Proexport of its contents or services.

1.7. LIABILITY FOR DAMAGE AND LOSS

The User will be liable for damage and loss of any kind that Proexport may suffer, directly or indirectly, as a result of failure to comply with any of the obligations arising from the General Terms and Conditions or the law in relation to the use of the Website.

2. PURPOSE

Through the Website, PROCOLOMBIA provides Users with access to and use of various services and content made available to Users by PROCOLOMBIA or by third party users of the Website and/or third party providers of services and content (the "Services").

PROCOLOMBIA reserves the right to unilaterally change, at any time and without prior notice, the presentation and configuration of the Website, as well as the Services and the conditions required to use the Website and the Services.

PROCOLOMBIA uses cookies when a User browses the pages of the Website. Our cookies are linked to an anonymous User only and their computer and do not provide references that allow the User's name and surname to be identified. PROCOLOMBIA cookies cannot read data from your hard drive or read the cookie files created by other providers. PROCOLOMBIA encrypts the User's identification details for greater security. PROCOLOMBIA ACCEPTS NO RESPONSIBILITY FOR ANY KIND OF DAMAGE OR LOSS RESULTING FROM THE USE OF THE SERVICES AND THE CONTENT BY USERS OR THAT MAY BE DUE TO THE LACK OF VERACITY, COMPLETENESS AND/OR AUTHENTICITY OF THE INFORMATION THAT USERS PROVIDE TO OTHER USERS ABOUT THEMSELVES, IN PARTICULAR FOR ANY DAMAGE AND LOSS CAUSED BY IDENTITY THEFT OF A THIRD PARTY BY A USER IN ANY KIND OF COMMUNICATION MADE THROUGH THE WEBSITE.

PROCOLOMBIA does not grant any license or authorization to use any kind of intellectual on industrial property rights or any other property or right related to the Website, Services or Content.

8. REFUSAL AND WITHDRAWAL OF ACCESS TO THE WEBSITE AND/OR THE SERVICES

PROCOLOMBIA reserves the right to refuse or withdraw access to the Website and/or the Services at any time and with no need for prior notice to Users who fail to comply with these General Terms and Conditions or the Specific Terms and Conditions that apply.

9. PROCEDURE IN THE EVENT OF THE VIOLATION OF INTELLECTUAL PROPERTY RIGHTS

11. TERM AND TERMINATION

These General Terms and Conditions are governed by the law of the Republic of Colombia.

PROCOLOMBIA and the User, expressly waiving any other jurisdiction, refer to the courts and tribunals of the city of Bogota DC.
